[3] examination

 

An application for design in Laos shall be conducted the formality examination and substantive examination with the alternate publication.

The examination as to formalities will be commenced from the filing date. The duration will take about two [02] months from the filing date.

 

Time limit to make the response to the Office Action is two [2] months counted from the issued date of the notice.

Duration of substantive examination is nine [09] months.

The design application will be published when 150 industrial design application/registrations are in order to be advertised but no later than six months from the filing date.

After granted, the design registration shall be published.

Normally, the whole duration for obtaining a Patent for design will take about twelve [12] months from the filing date.

 

[4] deferment of publication                                           

 

The deferment of publication is available in a period of twelve [12] months from the date of filing or priority date. In this period, the owner cannot institute court proceedings against any person or legal entity who infringes his/her industrial design.

 

[5] term & renewal

 

Term of protection of design is five [05] years from the filing date and renewable twice, each for five years, that is the maximum term of protection of design is fifteen [15] years.

 

A six-month grace period is allowed for the late payment of the renewal fee, with an additional surcharge.

 

Additionally, the maintenance of the patent design is also required. Accordingly, an annual fee shall be paid in advance each year.
