[1] definition

 

Industrial design is any composition of lines or colors or any three dimensional form or any material that give the appearance to a product and can serve as a pattern for a product. 

 

[2] protection criteria

 

An application for design shall be patented when it has:

 

- novelty.

 

[3] registrable subject matters

 

- drawings or designs;

- three-dimensional form of a product.

 

[4] non-registrable subject matters

 

The following subject matters are out of the design system:

 

- appearance of a product that is dictated by its technical features of the product;

- industrial designs contrary to social order or morality.

 

[5] multiple-design application

 

The multiple design applications are acceptable to be filed according to the Cambodia Patent Law.  However, at present there are not any multiple design application has been filed with Department of Industrial Property of Cambodia and the multiple design applications should be filed as the separate single design applications, each embodiment/variant is in one application.

 

[6] exception of novelty

 

An application for industrial design shall be deemed not have lacked novelty if it belongs to one of two circumstances below:

 

a) disclosure of the design occurred within twelve [12] months preceding the filing date or, where applicable, the priority date of the application; and 

b) disclosure of the design was in consequence of abuse or infringement by the third party over the applicant.
